The concept of “impeccable business reputation” has been introduced for Ukrainian carriers

Ukraine has adopted Law No. 4337 “On Improving the Regulation of the Market for Passenger and Freight Transportation Services by Road,” which amends the Law “On Road Transport.”

One of the key changes is the introduction of the concept of a carrier’s “impeccable business reputation.” 

From now on, systematic violations of traffic rules, tax laws, or labor regulations may serve as grounds for suspending a license. This means that market access now depends not only on the availability of vehicles but also on the company’s operational history.

The document also updates the requirements for a carrier’s financial condition. From now on, a business entity is required to confirm the availability of capital and reserves at a level sufficient to ensure the operation of vehicles, as failure to meet financial criteria now directly affects the right to remain in the market.

Carriers are also required to have a manager who meets professional competence criteria, which will encourage the formalization of labor relations and raise qualification requirements for staff.

According to Alona Veklich, Director of the MAPA Association, the entry into force of Law No. 4337 “On Improving the Regulation of the Market for Passenger and Freight Transportation Services by Road” marks the road transport market’s transition to a higher level of transparency. An impeccable reputation and financial capacity are becoming real economic assets, without which legal operations are impossible.
